All Terms and Conditions of this TOS (Terms of Service) may be modified at our sole discretion without prior warning. A change to this TOS does not constitute grounds for early contract termination or non-payment. Please check back regularly for any updates.

Use of Bakka Hosting's service constitutes acceptance and agreement to Bakka Hosting’s TOS (Terms of Service). From herewith in this TOS, the usage of “us”, “we”, “our”, “ours” shall constitute reference to Bakka Hosting, the usage of “you”, “your”, “they”, “them” shall refer to client / customer of Bakka Hosting.

Acceptance: Client agrees that by placing an order either by means of electronic ordering (web order form) and receipt of such order by Bakka Hosting, that you are agreeing to our TOS.

Refund: You may cancel your account at any time and receive a full refund (excluding Web Panel add-on and any setup fees or domain name registrations fees incurred) if cancelled within our seven (7) days money-back guarantee period.

Cancellation of Service: Customer accounts will be automatically billed on a monthly payment cycle unless customer requests a cancellation of service. Customer may cancel their service in our billing system or contact sales prior to their next billing date.

Responsibility for Content: Bakka Hosting takes no responsibility for any material created or accessible on or through Bakka Hosting's Networks and Services that is not posted by or at the request of Bakka Hosting. Bakka Hosting does not monitor nor exercise any editorial control over such material, but reserves the right to do so to the extent permitted by applicable law. Bakka Hosting is not responsible for the content of any web sites other than Bakka Hosting's web sites, including for the content of web sites linked to such Bakka Hosting's web sites. Links are provided as Internet navigation tools only.

Unsolicited Messages: Users may not send unsolicited e-mail messages, including, without limitation, bulk commercial advertising or informational announcements ("Spam") in a way that could be reasonably expected to adversely impact Bakka Hosting's Network and Services, including, without limitation, using an e-mail account on Bakka Hosting's network to send Spam, or using the service of another provider to send Spam or to promote a site hosted on or connected to Bakka Hosting's network. In addition, Users may not use Bakka Hosting's Network and Services in order to (a) send e-mail messages which are excessive and/ or intended to harass or annoy others, (b) continue to send e-mail messages to a recipient that has indicated that he/she does not wish to receive them, (c) send e-mail with forged TCP/IP packet header information, (d) send malicious e-mail, including, without limitation, "mailbombing", (e) send or receive e-mail messages in a manner that violates the use policies of any other internet service provider, or (f) use an e-mail box exclusively as a storage space for data.

System and Network Security: Users are prohibited from violating or attempting to violate the security of Bakka Hosting's Network and Services, including, without limitation, (a) accessing data not intended for such User or logging into a server or account which such User is not authorised to access, (b) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorisation, (c) attempting to interfere with, disrupt or disable service to any user, host or network, including, without limitation, via means of overloading, "flooding", "mailbombing" or "crashing", (d) forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting, or (e) taking any action in order to obtain services to which such User is not entitled. Violations of system or network security may result in civil or criminal liability. Bakka Hosting will investigate occurrences that may involve such violations and may involve, and co-operate with, law enforcement authorities in prosecuting Users who are involved in such violations.

VPS Bandwidth: If the bandwidth or speed of service used by you exceeds agreed quotas in a one month minimum period customer shall be billed overage fee of RM 2 per Gigabyte. Customer agrees that advertised bandwidth allowances represent the sum of the incoming and outgoing allowances.

System Resource: We may suspend your service in the event of overloading of our services until the system performance or other customers' service is affected which include but not limited to CPU resources overload, bandwidth overload, memory resources overload, MySQL connections overload and massive email spamming by scripts.

Management & Backup of Data: Customers are solely responsible for the management and backup of all customer data, and all updates, upgrades, patches etc.

Payment: Invoice is sent out 14 days before an account's due date. In the event of reaching invoice due date and no payment is made, customers will be given 7 days grace period after which the account will be put on suspension. Account that has spent 7 days in the suspension period may be terminated.

Free Domain Offer: Domains registered with free domain offer will be renewed with no charge annually as long as your subscribed service are paid. If you decide to leave before 1 year and you want to take the domain with you we will only release it once you have paid our normal domain registration fee. If you stay for 1 year or longer and then decide to leave you are free to take the domain at no charge.

Acceptable Use: Use of Bakka Hosting services to send SPAM is strictly forbidden. Pornographic, warez, IRC, open proxy, malicious software, peer-to-peer(P2P) filesharing, nulled script, attempting to disrupt networks or services, any other objectionable material/activity in any way, or any other illegal material/activity is strictly forbidden. Violation of any of these terms is grounds for account termination.

By accepting these terms of service, customer indemnifies Bakka Hosting of all responsibility for customer actions or result thereof. Bakka Hosting reserves the right to refuse service or terminate service at its discretion.
